   दंड संहिता अधिष्ठायी विधि है जबकि दंड प्रक्रिया संहिता प्रक्रियात्मक है.दूसरे शब्दों में , इसमें व्यवस्था दी गई है कि भारतीय दंड संहिता या किसी अन्य अधिनियम के अधीन आने वाले सभी अपराधों का अन्वेषण , जांच , विचारण आदि इस संहिता में दिए गए उपबंधों के अनुसार ही होंगे.दंड संहिता में उल्लिखित अपराधों पर कार्रवाई दांडिक न्यायालयों में की जाती है और भारत के किसी ऐसे व्यक्ति को जिसने कोई अपराध किया है , भारतीय दंड संहिता में दी गई व्यवस्था के अनुसार तथा दंड प्रक्रिया में वर्णित विधि से दंडित किया जा सकता है .
